Scotland wide parking legislation means that councils now have powers to enforce incorrect parking, including

  • parking on pavements
  • double parking
  • parking at crossing points
  • parking on verges, which lie between roads and pavements.

The new rules came into force on 11 December 2023. A national parking campaign has been in place to raise awareness of the new rules.

We began enforcing these rules on Wednesday 26 February 2025. 

What does it cost?

The value of a PCN is £100.00 however a discounted amount of £50.00 will be accepted as full payment if received within 14 days of issue.

Payment of £50.00 received after the 14 days has expired will be considered as part-payment and the balance will remain due.

Payment may be made here. Photographs of the contravention can be viewed once the vehicle details and PCN number have been entered.

If payment remains outstanding 28 days after a 'Penalty Charge Notice' has been issued or after an appeal or representation has been refused, we may issue a 'Charge Certificate' increasing the penalty by a further 50% of the original charge.

Appeals

The PCN displays the alleged contravention together with the place, time and date that it occurred. If you feel it was incorrectly issued, you can make an appeal here.

If your appeal is rejected you will be sent a reply explaining the reasons why, and advising what you can do next.

If your appeal is accepted the PCN will be withdrawn and you will be notified.

Is there a right of appeal against an Enforcement Notice?

There is a right of appeal. The regulations set out the grounds on which the registered keeper can make representations to us; these are listed on the Enforcement Notice.

You can make representations against the Enforcement Notice within 28 days, beginning with the date of service. If you make representations out with this period then they may be rejected. We will send you a response. It will be either a "Notice of Acceptance" or a "Notice of Rejection."

If we reject your representation, you have the right to appeal to an independent adjudicator namely, the First Tier Tribunal Service. We will enclose the appropriate details to enable you to appeal to them with the "Notice of Rejection". If the First Tier Tribunal Service rejects your appeal, the amount payable will be the full £100.

Do not ignore a Pavement Parking  Enforcement Notice

It will carry additional charges if it is not paid (or contested) promptly.

  • If payment remains outstanding 28 days after an 'Enforcement Notice' has been issued or after an appeal or representation has been refused we may issue a 'Charge Certificate' increasing the penalty by a further 50% of the original charge.
  • Upon the issue of a Charge Certificate, your right of appeal has been removed. If the Notice remains unpaid, it may be passed to our debt recovery agent for further action.
